Beyeler Shop – General Terms and Conditions

1. Scope of application

  1. These General Terms and Conditions, as amended at the time of conclusion of the contract, apply to all business relationships between the shop of Beyeler Museum AG (hereinafter referred to as the 'Fondation Beyeler shop') and its customers.
  2. By submitting an order or performing a download, the customer expressly agrees to these General Terms and Conditions.
  3. These General Terms and Conditions apply exclusively. Any terms and conditions of the customer that conflict with or deviate from these terms and conditions will not be accepted unless the Beyeler Shop has expressly agreed to them in writing in individual cases.

2. Registration

  1. Each order requires prior sign-in as a registered customer or as a guest customer of the Beyeler Shop. Upon successful completion of the sign-in process, Beyeler Shop customers will be admitted to the system.
  2. Admission can be revoked by the Beyeler Shop at any time. In this event, the Beyeler Shop is entitled to block and delete the username and the corresponding password immediately.

3. Conclusion of contract

  1. The presentation of the Beyeler Shop's range does not constitute an offer to conclude a purchase contract with the customer. It is non-binding.
  2. The contract is concluded when the Beyeler Shop accepts the offer of contract submitted with the customer's order by means of an order confirmation sent by email. This order confirmation describes the essential contents of the order. Customers must check the order confirmation for obvious clerical and arithmetic errors as well as for discrepancies between the order and the confirmation. The Fondation Beyeler shop must be informed immediately of any discrepancies.
  3. If the customer provided an incorrect email address when placing an order and the order confirmation cannot be delivered by the Fondation Beyeler shop, the contract will be concluded if the Beyeler Shop can send the order confirmation to the customer via other means.
  4. If the Beyeler Shop is unable to accept the customer's offer, the customer will be informed of the unavailability or rejection of the order instead of the order acceptance. Temporarily unavailable goods will be earmarked for the customer; the customer's order will remain in place. If necessary, the Beyeler Shop will inform customers separately of possible errors in the information on the product range on the website and make a corresponding counter-offer.

4. Prices, minimum order value

  1. Prices may change. The price quoted at the time the offer is submitted in accordance with section 3 paragraph 2 of these General Terms and Conditions shall apply.
  2. The minimum order value is CHF 20. Where an order's value does not reach the minimum, the difference between the actual order value and the minimum order value will automatically be added to the order. Downloads are excluded from this surcharge.

5. Delivery, shipping costs

  1. The Beyeler Shop will deliver the ordered goods to the address specified by the customer in the order without delay. The Fondation Beyeler shop is entitled to make partial deliveries and provide partial services at any time, provided that these are reasonable for the customer. If partial deliveries are made by the Beyeler Shop, the Beyeler Shop shall bear the additional postage costs.
  2. Delivery will be subject to the shipping costs shown in each individual case.
  3. All delivery dates or periods communicated by the Beyeler Shop are non-binding.
  4. Deliveries are made only to end customers. The Beyeler Shop reserves the right to limit quantities.
  5. If the order is redelivered due to incorrect address details, the customer shall bear the additional shipping costs incurred.

6. Customs duties, VAT

  1. Goods imported into countries outside Switzerland may be subject to import duties that customers will need to pay. These vary between customs territories. Customers are responsible for proper payment of the necessary customs duties and fees. Import duties are not shipping costs.
  2. For deliveries within Switzerland, the price shown includes the applicable statutory VAT. For exports to other countries, the price shown is the net price excluding VAT. Customers are responsible for proper payment of the country-specific VAT. This is not included in the shipping costs.

7. Order collection

  1. Orders can be paid for in our online shop and picked up from the museum shop (during museum opening hours).
  2. Customers will be contacted regarding collection within three working days of ordering.
  3. Once they have been contacted, the customer will have a maximum of 14 days to collect the order from the museum shop.
  4. If the order is not collected after 14 days, we provide a grace period of another 14 days. In this case, additional storage costs will be charged.
  5. If the order is not collected within the deadline, the purchase contract will be rescinded. We reserve the right to grant deadline extensions as a gesture of goodwill. In this case, please contact our customer service team as soon as possible: shop@fondationbeyeler.ch or +41 61 645 97 25.
  6. Order collection must be confirmed by signature.
  7. The 14-day withdrawal period begins upon receipt/collection of the goods.
  8. The Beyeler Shop reserves the right to exclude items that are not suitable for collection from this option.

8. Due dates and terms of payment, default

  1. The purchase price is due for payment upon conclusion of the contract. In the event of default of payment, the Beyeler Shop is entitled to charge default interest at the rate of 5% p.a.
  2. Online payment can be made using all common payment methods such as credit card, Twint and PostFinance.
  3. The contract and invoice currency is CHF.

9. Retention of title, withdrawal

  1. The delivered goods remain the property of the Beyeler Shop until receipt of all payments under the contract. In the event of default in payment, the Beyeler Shop is entitled to withdraw from the contract and to demand the return of the goods.
  2. In the event that a supplier fails to deliver the ordered goods despite a contractual obligation and the Beyeler Shop is permanently prevented from providing services through no fault of its own, the Beyeler Shop is entitled to withdraw from the contract. The Beyeler Shop will notify customers straight away in the event of an impediment to performance and immediately refund any payments already made.

10. Right of withdrawal

  1. Customers have the right to cancel the purchase contract within 14 days after the goods have been received by the intended recipient, without giving reasons, in writing, on another durable medium, by email (shop@fondationbeyeler.ch) or by returning the goods.
    Timely dispatch to the following address is sufficient for meeting the deadline for exercising the right of withdrawal:

  2. The right of withdrawal is excluded for contracts for
    • The supply of perishable goods
    • The supply of goods that are not suitable for return due to their nature (e.g. e-books, downloads, etc.)
    • The supply of newspapers, journals, magazines, yearbooks and calendars
    • The supply of posters and art prints
    • The supply of DVDs, CDs, e-book readers, videos, music cassettes and software, unless they are unused, welded or sealed and returned in their original packaging
    • The supply of goods that have been manufactured according to the customer's specifications, as well as goods purchased abroad specifically for the customer that are marked as such in the detailed view
  3. If a customer returns an order excluded from revocation, they shall bear the costs for resending the order.
  4. In the event of a valid revocation, the customer is obliged to return the received goods. If the customer is unable to return the goods received in whole or in part or only in used or deteriorated condition, the customer shall compensate the Beyeler Shop for the corresponding depreciation in value in the event of cancellation. If the customer has already paid the purchase price, the Beyeler Shop is entitled to deduct the depreciation in value from the repayment amount. In individual cases, the depreciation may correspond to the purchase price paid.
  5. The customer shall bear the costs (including import duties for deliveries outside Switzerland and shipping costs) and risk of returning the goods, unless the delivered goods do not correspond to those ordered.
  6. The Beyeler Shop shall make use of its right of retention until the goods have been returned in full.

11. Offsetting, retention

Offsetting is only permissible if your claim has been legally established or recognised. The right of retention only exists if your counter-claim is based on the same contractual relationship.

12. Warranty, liability

  1. Customers must inspect the goods upon receipt. Any defects must be reported immediately to the Beyeler Shop. If the customer neglects to do so, the goods shall be deemed to have been accepted unless they are defects that were not detectable during the routine inspection. If such defects occur later, the notification must be made immediately upon discovery, failing which the item shall be deemed to have been approved also with regard to these defects.
  2. If, at the time of the transfer of risk, there is a defect in the purchased item for which the Beyeler Shop is responsible, the Beyeler Shop may choose to offer rectification or replacement delivery. If the rectification or replacement delivery fails, the customer shall be entitled either to withdraw from the contract or to demand a reduction of the purchase price.
  3. The liability of the Beyeler Shop, its representatives and its auxiliaries is limited to intent and gross negligence. The Fondation Beyeler shop is not liable for indirect damage or loss of profit. Product liability remains unaffected.

14. Data protection

  1. The data necessary for the processing of business transactions is stored in strict compliance with the applicable legal provisions and only passed on to other companies for order processing. All personal data will be treated confidentially. The Beyeler Shop is entitled to transfer personal data to companies affiliated with the Beyeler Shop for the purpose of credit checks and creditworthiness monitoring as part of data-sharing.
  2. Customers of the Foundation Beyeler shop can view and edit their own user information at any time in the protected area of the homepage after logging in. Further information on data protection can be found in the Fondation Beyeler's privacy policy.

15. Usage rights (including downloads)

  1. All goods offered are intended for your private, non-commercial use only. Any other use constitutes a violation of copyright. The making of copies for the purpose of sale, commercial lending, public broadcast or disclosure or transfer to third parties is prohibited.
  2. With regard to the purchase of music content from our product range, customers only receive the rights of use specified in the respective product description, e.g. the right to download a song, to stream it, to play it on a PC, to burn it to a CD or to transfer it to a portable player.

16. Applicable law and place of jurisdiction

The law of Switzerland shall apply, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all claims in connection with your order is Basel-Stadt.
